Clarification about the new child care licensing regulations

Based on feedback the division has received we recognize that the email about Afterschool Child Care Regulations may have caused some confusion. We would like to clarify the process for all of the child care licensing regulations.

  • Afterschool Child Care Program Regulations - this are licensing regulations for programs licensed as a school age program and only care for children who are school aged. The new regulations that were approved in November 2014, and will go into effect on January 1st, 2016
  • Family Child Care Home regulations - currently there are two sets of regulations, one for licensed child care homes, and the other for registered child care homes. The current rules are still in effect, and programs should be in compliance with these rules for all ages children they serve. These regulations are still being promulgated, and are proposed to be moved into one set of regulations. These regulations are for programs in a individual's home. CDD received public feedback, and is currently processing the thousands of comments received and determining if changes will be made to the proposed documents. CDD hopes to finish this process in January, and once complete will make public the responses to all comments and any proposed changes. The regulations will then need to be approved by the Legislative Committee on Administrative Rules.
  • Center based regulations - there are currently (still in effect) two sets of regulations, one for early childhood programs, and one for non recurring care programs. These programs will follow these center based regulations for all ages they are licensed to care for, including school age children. CDD is still in the promulgation process to combine these regulations into one set. CDD received public feedback, and is currently processing the thousands of comments received and determining if changes will be made to the proposed documents. CDD hopes to finish this process in January, and once complete will make public the responses to all comments and any proposed changes. The regulations will then need to be approved by the Legislative Committee on Administrative Rules.
